What’s an LCA?

A Labor Condition Application (LCA) must be filed in support of H-1B and E-3 work visa petitions to confirm the pay and working conditions of the foreign employee. When filing an LCA, employers must comply with posting requirements and public access file (PAF) record keeping requirements that can be burdensome and time-consuming.

What are the Posting Rules for LCAs?

Employers are required to provide public notice of the LCA, which they can do in one of two ways:

Option 1 (Paper-Based): Post a hard copy of the LCA in two locations, at each employee worksite location, for 10 days.

Option 2 (Electronic): Post a copy of the LCA electronically on the company’s website or intranet for 10 days.

What are the PAF Record Keeping Rules?

Employers are required to store LCA records in a Public Access File (PAF), which they can do in one of two ways:

Option 1 (Paper-Based): Keep hard copies of required PAF documentation in their office.

Option 2 (Electronic): Digitally store required PAF documentation.
